O question 1greenspun.com : LUSENET : Lessig's Contracts : One Thread |
(1) A and B enter a contract where A agrees to buy, and B agrees to sell, 500 acres of land. The contract is in writing, and the land is described as the large farm. When the time for performance comes, A insists that the large farm refers to a farm that is different from the farm B believes it refers to. The written contract, however, says this contract states the full and complete agreement that exists between the parties. Under the principles of the Restatement, may A introduce evidence to show which farm was intended?
