I have written to this site before, and have found it so reassuring. Could someone please help with some advice in what to do next? I have been writing to DLA for over a year, letters going back & forth - the usual threats of court. Back in Sep 00, I did send my I & E to them, ( I had not found this site then). I have asked & asked for all the documents I require, but still nothing, so in my last letter I quoted the CPR to them, and that I have a right to all documents I have requested. They completely ignored my request (yet again) and have asked for my I & E form saying they will not tolerate any further delay.So if I say I sent it last Sep 00 they will ask for a copy,and say they did not receive it then. But if I did not send it, how come its taken them over a year to ask for it. If I ignore it they will say I am ignoring their comments.
Please advise, I am so confused

You need a simple reply letter:Further to your letter of the xth month.
I have reviewed the contents of your form with my legal advisors. My understanding is that you have no legal right to this information and on this basis I am declining to complete your form. If your client believes they are entitled to this information, you should write further, stating your reasons.
By contrast I note that my requests for information pertaining to the claim your client is pursuing - which I am legally entitled to - remain unanswered. Specifically I draw your attention to my letters of the a,b,c,d,e, [list them all here]. I would welcome either the information being supplied, or in its continued absence the courtesy of an explanation for this delay.

If you want the information you should sarn them for it; otherwise always be polite but firm; just like they do, keep singing the same tune.

I gather you sent in the I&E before being aware of your legal rights. Did you think in any way that you *had* to return that I&E form, because of the way in which the lender phrased its request or demand? This is a potential scandal in the making, I reckon, IMHO.
