1991 MORTGAGE CONTRACT REQUIRED "HALIFAX"

DEBT = £15,000, RE "MIG". HALIFAX = LENDER. ROYAL SUN = INSURER & "CURTIS SOLICITORS" ARE TRYING TO COLLECT. I HAVE ASKED THE COURT TO SET ASIDE THE DEBT ON THE GROUNDS OF THE "LIMITATION ACT 1980". WHAT I REQUIRE IS A COPY OF A MORTGAGE CONTRACT DATING AROUND 1991-2. I WISH TO LOOK THROUGH THIS TO FIND IF THE CONTRACTS OF THESE DATES HAD ANY PHRASES ALONG THE LINES OF "ANY SHORTFALL WILL BE TREATED AS PART OF THE ORIGINAL DEBT". I HAVE HAD NO RESPONSE FROM ANY OF THE ABOVE COMPANIES. THANK YOU TO ANYONE WHO MAY HELP.

Answers

The Halifax mortgage contracts refer to the Halifax Mortgage Conditions in force at that time. In my own case I have a copy of the 1985 conditions, but there are probably revised conditions by 1991. I repeatedly asked the Halifax for a copy of the Mortgage Deed and Terms and Conditions and they eventually complied.
